Contracting party

Your contracting party for the Hugo services depends on your region.

For customers in North America, oceans next generation Inc. (770 St George Blvd, Moncton, NB E1E 2C6, Canada) is your contracting party and the terms agreed with that company apply. Hosting there is provided by cloud&more Inc., the oceans Group’s own hosting company in Canada with data centres in Canada and the USA; you conclude a separate contract directly with cloud&more (cloud&more terms).

§ 1 Scope and customers

This page covers the Hugo services of oceans GmbH, Lindenweg 2, 04668 Grimma, Germany. All contracts for Hugo services in Europe are governed by the General Terms and Conditions of oceans GmbH as published from time to time: oc-ans.com/en/terms.

The Hugo services are addressed exclusively to entrepreneurs within the meaning of section 14 of the German Civil Code, to legal entities under public law and to special funds under public law. No contracts are concluded with consumers (section 13 of the German Civil Code).

Deviating or supplementary terms of the customer are rejected; they become part of the contract only if we expressly agree to them in text form.

§ 2 Services

Hugo is the identity and access service of the oceans Group: authentication, user and permission management, and single sign-on for the connected systems.

The specific scope of services, prices, term and any service level agreement follow from the respective individual offer or service description. A specific availability is owed only where it is expressly promised in a service level agreement.

Enquiry, not an order. Nothing can be ordered through this website. The presentation of services and prices is without obligation and does not constitute an offer in the legal sense; the forms serve exclusively for a non-binding enquiry. Submitting a form does not place an order, does not conclude a contract and does not create any payment obligation. A contract is concluded only through an individual offer and its acceptance.

§ 3 Prices and taxes

All prices shown on this website are net prices, excluding tax. The applicable sales tax (VAT, GST/HST) is added based on the customer’s country and region.

Prices stated on the website are non-binding and for orientation only. Only the prices in the individual offer are binding; the taxes shown there follow from the customer’s domicile and the place of supply.

§ 4 Governing terms

Conclusion of contract, fees and payment, term and termination, availability and maintenance, duties to cooperate, rights of use, data protection and processing on your behalf, confidentiality, information security, claims for defects, liability as well as governing law and place of jurisdiction are governed entirely by the Terms and Conditions of oceans GmbH: View the full Terms and Conditions of oceans GmbH.

In the event of any discrepancy between this page and the Terms of oceans GmbH, the version published at oc-ans.com prevails. The language of the contract is German; the German version is authoritative.

§ 5 Data protection

How we process personal data in connection with this website is described in our privacy policy. Where we process personal data on behalf of the customer as part of the services, the parties conclude a data processing agreement pursuant to Article 28 GDPR; that agreement takes precedence over the terms.
